California State Truck Laws
As California tractor trailer accident lawyers with more than 30 years of experience, we frequently handle truck accidents involving noncompliance with our state's truck laws. The following are some of California's truck laws:
- Right lane rule: Commercial trucks must ride in the far right lane of traffic.
- Speed limits: Many vehicles must comply with a 55 MPH speed limit.
- Driving offenses: Truck drivers with several different types of driving offenses can lose their commercial driver's license.
- Alcohol use: Under our state's law, it is illegal to drive a truck with a blood alcohol content (BAC) of 0.04% or more.
In addition to state regulations, federal truck regulations are set by the Federal Motor Carrier Safety Administration (FMCSA), which is a division of the U.S. Department of Transportation (DOT). FMCSA laws include:
- Hours of service rule: Truck drivers cannot drive for more than 11 hours after 10 consecutive hours off duty. If a driver has worked 60 hours in seven days (or, in some cases, 70 hours in an eight-day period), they are not eligible to operate the truck.
- Size, weight and load regulations: Trucks can only be loaded to a certain height, width and weight.
- Workplace drug and alcohol testing programs: These programs must be followed by trucking companies and their employees or contractors.
- Noise and pollution emission standards
- Inspection, maintenance and repair standards: Trucks must be inspected regularly and maintained or repaired before going back out on the road.
Noncompliance with federal and state regulations can result in rollover accidents, rear-end collisions, T-bone accidents, head-on collisions and other very serious accidents.
